Applying for review of an improvement notice by the State Mining Engineer should be submitted online using the Safety Regulation System (SRS).
Who can apply?
The person issued with the notice, the mine manager or the principal employer may refer an improvement notice to the State Mining Engineer for review. This must be done before the remedy date on the notice.
If the applicant is not the manager of a mine, a copy of the completed form must be sent to the manager as soon as practicable. A copy of the application must be attached to the mine record book.
What happens during the review process?
The improvement notice is suspended until the State Mining Engineer gives written permission to the contrary.
The State Mining Engineer’s decision may be appealed to the Occupational Safety and Health Tribunal. If there is no appeal, the notice must be complied with. Failure to comply is an offence under the Mines Safety and Inspection Act 1994.
An improvement notice can be referred for review electronically via the Safety Regulation System (SRS).
For those rare instances where the notice is not available in SRS, a signed and completed application form must be accompanied by a copy of the improvement notice and, if applicable, any additional documents supporting the request for an extension or review.
Lodging the application
Through SRS, industry users can request a review of a notice by clicking on ‘Request review’ under the notice tab whilst in the appropriate notice.
In those occasions where a paper notice has been issued, the completed and signed application and supporting documentation can be emailed to email@example.com
